Extended Statute of Limitations for NJ Sexual Abuse Claims

New Jersey residents who are sexually abused as children will now have up to 20 years to sue their abusers under new legislation signed into law by Governor Phil Murphy.

The bill, which passed both chambers unanimously, takes effect December 1, 2019, meaning that child sex abuse victims who suffer from delayed effects of trauma will finally have some justice.

Previously, New Jersey had one of the shortest statutes of limitations for such cases, allowing survivors to bring suit within three years of the incident. In 2017, however, the state legislature extended the statute to 10 years. However, the new law goes even further—it allows anyone whose childhood sexual abuse occurred prior to January 1, 2002, to file a lawsuit until they reach age 55.

Additionally, the law gives victims of childhood sexual abuse who suffered from delayed effects of trauma additional time to pursue legal action. These include those who experienced psychological damage due to the abuse, including post-traumatic stress disorder (PTSD), anxiety, depression, suicidal thoughts, self-harm, eating disorders, substance abuse, and low self-esteem.

The law also requires every New Jersey school to have a policy regarding reporting different forms of sexual abuse including aggravated sexual assault and to conduct training programs for staff and students.
